Obama administration urges court to overturn Calif. gay marriage ban

The Obama administration has waded into the legal battle over California's gay marriage ban, filing a brief with the Supreme Court Thursday evening that argues the state's voters did not have the right to decide gay couples cannot wed.

In the brief, the Justice Department--which is not involved in the case--argues that the gay marriage ban violated same-sex couples' constitutional guarantee to equal protection under the law and is the result of prejudice.

"Prejudice may not...be the basis for differential treatment under the law," the brief said.

But the Obama administration stopped short of calling for a countrywide guarantee of equal access to marriage for gay people in the brief, keeping its arguments focused on California.

"Throughout history, we have seen the unjust consequences of decisions and policies rooted in discrimination," Attorney General Eric Holder said in a statement. "The issues before the Supreme Court in this case ... are not just important to the tens of thousands of Americans who are being denied equal benefits and rights under our laws, but to our Nation as a whole.?

The California ballot initiative, called Proposition 8, was passed in 2008 with 52 percent of the vote and reversed an earlier state Supreme Court decision allowing gay marriage in the state. Thousands of gay couples in the state had already tied the knot when the ban passed.

In its brief, the Obama administration also argued that laws targeting gays and lesbians specifically should face "heightened scrutiny" from the courts, since gay people have faced a history of discrimination, share a trait they cannot change, and lack political power.

President Barack Obama announced last year that he believes gay couples should be allowed to get married but did not say they have a constitutional right to wed.

At his inaugural address in January, Obama seemed to suggest he did believe the government has a role in ensuring gay people are allowed to marry. "Our journey is not complete until our gay brothers and sisters are treated like anyone else under the law?for if we are truly created equal, then surely the love we commit to one another must be equal as well," he said then.

Two federal courts have already decided that Proposition 8 is unconstitutional, saying it discriminates against a group of people without proving there is a legitimate government interest in doing so. The higher of the two courts, the 9th U.S. Circuit Court of Appeals, decided the case in a way that ensures it will affect only California and will not invalidate gay marriage bans in the dozens of other states that have adopted them.

But it's possible the Supreme Court could take a broader view of the case when it hears oral arguments in late March. Justices could decide whether or not there is a fundamental right to marriage that the government cannot deny people based on sexual orientation. If they uphold Proposition 8 under these terms and allow the ban on same sex nuptials to stand, the ruling could cement state gay marriage bans for decades.

More than 100 Republicans, including former Utah Gov. Jon Huntsman, signed a brief filed earlier in the week encouraging the court to strike down Proposition 8. One of the lead attorneys arguing against the ban is Ted Olson, the former solicitor general under George W. Bush.

The president of the anti-gay marriage group Family Research Council, Tony Perkins, criticized Obama for what he termed "hypocrisy" on gay marriage. "This is a sharp reversal from the position President Obama articulated just last May, when he declared that this is an issue that is gonna be worked out at the local level," Perkins said.

Benedict becomes 1st pope in 600 years to resign

CASTEL GANDOLFO, Italy (AP) ? Benedict XVI became the first pope in 600 years to resign Thursday, ending an eight-year pontificate shaped by struggles to move the church past sex abuse scandals and to reawaken Christianity in an indifferent world.

As bells tolled, the Swiss Guards standing at attention in Castel Gandolfo shut the doors of the palazzo shortly after 8 p.m. Thursday (2 p.m. EST), symbolically closing out a papacy whose legacy will be most marked by the way it ended ? a resignation instead of a death.

In a changing of the guard, the Swiss Guards in their yellow-and-blue striped uniforms handed over responsibility of protecting the 85-year-old Benedict to Vatican police as some of the faithful outside shouted "Viva il papa!" ? Long live the pope!

The pope's journey into retirement began with an emotional send-off from the Vatican, with Swiss Guards in full regalia and prelates kneeling to kiss Benedict's papal ring one last time. Benedict's closest aide wept by his side as they took their final walk down the marbled halls of the Apostolic Palace.

As bells tolled in St. Peter's and in church towers across Rome, Benedict flew by helicopter to the papal vacation retreat in Castel Gandolfo in the hills south of Rome, where he will spend the first two months of his retirement.

Benedict leaves behind a church in crisis, still coping with the fallout of the sex abuse scandals, a central Vatican administration torn by divisions, and what Benedict said was a crisis of faith, with baptized Catholics in places of ancient Christian tradition thinking they can do without God.

In his final public remarks as pope, Benedict pledged to continue working for the good of the church in his retirement. Arms raised, he told a packed piazza from the palace balcony that as of his retirement, "I am simply a pilgrim beginning the last leg of his pilgrimage on this Earth."

Benedict also reached out to the wider world electronically, sending a final tweet from his Twitter account, (at)Pontifex: "Thank you for your love and support. May you always experience the joy that comes from putting Christ at the centre of your lives."

The day began with Benedict's final audience with his cardinals, where he pledged his "unconditional reverence and obedience" to his successor, a poignant and powerful message that was utterly unexpected.

Inside the Vatican's frescoed Clementine Hall, the pope appeared to be trying to defuse concerns about his future role and the possible conflicts arising from the peculiar situation of having both a reigning pope and a retired one.

Benedict also gave a final set of instructions to the "princes" of the church who will elect his successor, urging them to be united as they huddle to choose the 266th leader of the world's 1.2 billion Catholics.

"May the College of Cardinals work like an orchestra, where diversity ? an expression of the universal church ? always works toward a higher and harmonious agreement," he said.

It was seen as a clear reference to the deep internal divisions that have come to the fore in recent months following the leaks of sensitive Vatican documents that exposed power struggles and allegations of corruption inside the Vatican.

The audience inside the Apostolic Palace was as unique as Benedict's decision to quit, with the pope, wearing his crimson velvet cape and using a cane, bidding farewell to his closest advisers and the cardinals themselves bowing to kiss his fisherman's ring for the last time.

Some seemed to choke up at that moment, and a few lingered on to chat with the pope for as long as they could. But the scene seemed otherwise almost normal, with cardinals chatting on the sidelines waiting their turn to say goodbye.

Benedict said he would pray for the cardinals in coming days as they discuss the issues facing the church, the qualities needed in a new pope, and as they prepare to enter into the secret conclave to elect him.

Benedict's decision to live at the Vatican in retirement, be called "emeritus pope" and "Your Holiness" and wear the white cassock associated with the papacy has deepened concerns about the shadow he might cast over the next papacy.

But Benedict has tried to address those worries over the past two weeks, saying that once retired he would be "hidden from the world" and living a life of prayer.

In his final speech in St. Peter's Square on Wednesday, he said he wasn't returning to private life exactly, but rather to a new form of service to the church through prayer.

And on Thursday he went even further, when he told the cardinals, "Among you is also the future pope, whom I today promise my unconditional reverence and obedience."

The Vatican spokesman, the Rev. Federico Lombardi, said the pope's pledge was in keeping with this effort to "explain how he intends to live this unprecedented situation of an emeritus pope."

"He has no intention of interfering in the position or the decisions or the activity of his successor," Lombardi said. "But as every member of the church, he says fully that he recognizes the authority of the supreme pastor of the church who will be elected to succeed him."

The issue of papal obedience is important for Benedict. In his last legal document, he made new provisions for cardinals to make a formal, public pledge of obedience to the new pope at his installation Mass, in addition to the private one they traditionally make inside the Sistine Chapel immediately after he is elected.

On Monday, the cardinals are expected to begin meeting to set the date for the conclave.

Benedict's decision to retire has been met for the most part with praise and understanding. Cardinals, Vatican officials and ordinary Catholics have rallied around him in acknowledgment of his frail state and the church's need for a strong leader.

But Sydney Cardinal George Pell has caused a stir by openly saying the resignation has been "slightly destabilizing" for the church.

In an interview with Australian Broadcasting Corp., Pell noted that Benedict himself had acknowledged the shift in tradition; Benedict said Wednesday that he appreciated his decision was not only serious but "a novelty" for the church.

Pell also said the church was in sore need of a strong manager ? comments echoed by several cardinals who have noted the 30-year reign of two popes who paid scant attention to the internal governance of the church.

The Vatican tried to downplay Pell's comments, saying it wouldn't respond to individual cardinals and urging the media not to take advantage of churchmen who, it said, aren't necessarily media savvy.

Despite ?child porn? remark by South Dakota legislator, MMA on its way to regulation there

It turns out comparing MMA to child porn is not the best lobbying technique. After a congressman in South Dakota rallied against a bill to regulate MMA by calling it "the child porn of sports," the bill still passed through the South Dakota House 50-20.

Steve Hickey, the representative who grabbed plenty of headlines by fighting against MMA's regulation in his state, tried to add an amendment to create a commission that would oversee different disciplines of martial arts but not MMA, because that makes a ton of sense. Wait, no, it doesn't. The South Dakotan House saw the lack of sense in that amendment and defeated it.

After the bill makes a quick stop in the Senate to review the amendments that were passed, the bill will head to the desk of South Dakota governor Dennis Daugaard. He has strongly opposed MMA in the past, but the South Dakota Argus Leader says it will still likely become a law:

Daugaard could sign the bill, veto it, or let it become law without his signature. Both houses of the Legislature passed the fight commission bill with margins sufficient to override any veto.

Hickey's remarks about MMA brought back memories of governments across the country banning "no-holds barred" fighting in the late 90s, and Senator John McCain calling MMA "human cockfighting." Since then, regulation and rules have turned MMA into the sport we know today. It's now regulated in 46 states, and in 2007, McCain even praised MMA's progress.

Buzz off: Pa. honeybee colony getting new home

(AP) ? They say home is where the hive is. Or something like that.

A colony of troublesome honeybees will settle into new digs in northeastern Pennsylvania after being removed Friday from a back alley in Duryea, where the queen and thousands of her loyal subjects had taken up residence in an old tree several years ago.

They were such a nuisance that neighbors say they couldn't stand to be outside in the summertime. The bees got into garbage and recycling bins, disrupted barbecues and buzzed anyone who got too close.

"It was a big safety issue for us," said Joe Roscioli, 32, who is allergic to bees and whose house is only a few feet from the tree.

Years ago, an annoyed human might've eliminated the problem with a can of insecticide.

But with a mysterious affliction called colony collapse disorder decimating hives around the nation, Duryea's streets supervisor got a bee in his bonnet to save the colony and its 10,000 to 20,000 occupants. So on Friday, PPL Electric Utilities, a tree-trimming crew and several bee experts converged on the alley for a rescue operation.

With a small crowd looking on, licensed apiarist Bill Fisher and other experts drilled several holes in the tree, then inserted probes to establish the lower and upper limits of the hive.

"It's a lot like a colonoscopy for bees," Fisher joked.

Once the 60-foot northern catalpa tree was cut down to size, a crane lifted a 15-foot section of trunk onto a trailer destined for the Hershey area, where Fisher has a small farm. When it gets warmer, Fisher will try to extract the queen, slice out the comb, and transfer the colony to a bee box. Its ultimate destination, if all goes well, is a community garden in Drums, about 30 miles southwest of Duryea.

Such rescues are becoming more common. The state Department of Agriculture said it's seen an increase in calls from exterminators, residents and business owners who want to avoid destroying inconvenient hives and are seeking help.

"Colony collapse disorder has really increased awareness of the importance of honeybees," said Karen Roccasecca, Pennsylvania's state apiarist.

Gino Marriggi, the Duryea streets supervisor who launched Friday's rescue mission, said he couldn't be happier with the outcome.

"The neighbors are happy the bees are going to be gone, and I'm happy nobody's going to destroy them," he said. "It's a win-win."
